Article 3 – Applicability
-
These Terms and Conditions apply to every offer made by Carder Essentials and to every agreement entered into between Carder Essentials and the consumer.
-
Before the agreement is concluded, the consumer is given the opportunity to view and save these Terms and Conditions.
-
If the agreement is concluded electronically, these Terms and Conditions will be made available electronically.
-
By placing an order through Carder Essentials, the consumer agrees to these Terms and Conditions.
-
If additional conditions apply alongside these Terms and Conditions, they will be clearly communicated to the consumer before the agreement is concluded.
-
If any provision of these Terms and Conditions conflicts with mandatory Dutch or European consumer law, the applicable consumer law will prevail.
-
If one or more provisions of these Terms and Conditions are wholly or partially invalid or unenforceable, the remaining provisions will remain fully in force.
Article 4 – The offer
-
Carder Essentials describes the products offered as fully and accurately as reasonably possible.
-
The offer contains sufficient information to enable the consumer to properly assess the product.
-
Product images are intended to provide the most accurate possible representation of the products.
-
Due to differences in screen settings, photography, lighting or production, colours and other visual characteristics may differ slightly from how they appear on screen.
-
Minor visual differences do not affect the consumer’s statutory rights if the delivered product materially differs from what was agreed or what could reasonably have been expected.
-
Material, dimensions, colour, finish and other relevant product characteristics will be stated with the relevant product where applicable.
-
For watches and other suitable products, Carder Essentials may use protective films and/or a control tag.
-
These protective films and the control tag are intended to protect the product during storage and shipping and to help assess the condition of the product in the event of a return.
-
Obvious mistakes or errors in, for example, prices, product descriptions or other information do not bind Carder Essentials if the consumer could reasonably understand that an error had occurred.
-
If an offer is valid only for a limited period or subject to certain conditions, this will be clearly stated.
-
All offers are subject to availability, unless otherwise indicated.
-
Before the order is completed, the following will be clearly displayed, among other things:
-
the price including applicable taxes;
-
any shipping costs;
-
the main characteristics of the product;
-
the available payment methods;
-
the applicable delivery information;
-
and the existence of the right of withdrawal, where applicable.
Article 5 – The agreement
-
The agreement is concluded when the consumer accepts the offer, places the order and Carder Essentials electronically confirms the order.
-
After placing the order, the consumer receives an order confirmation at the email address provided.
-
Carder Essentials takes appropriate technical and organisational measures to secure electronic transactions and personal data.
-
Carder Essentials may refuse or cancel an order if there is a legitimate reason to do so, including:
-
an obvious pricing or system error;
-
suspected fraud or misuse;
-
incorrect or incomplete customer information;
-
or unavailability of the ordered product.
-
-
If an order that has already been paid for is cancelled by Carder Essentials, the amount paid for that order will be refunded.
-
Every order is subject to sufficient availability of the relevant products.
Article 6 – Right of withdrawal and 60-day returns
Statutory right of withdrawal
-
When purchasing products through Carder Essentials, the consumer is in principle entitled to the statutory right to withdraw from the agreement without giving any reason within 14 days.
-
The statutory cooling-off period starts on the day after the consumer, or a third party designated in advance by the consumer who is not the carrier, has received the product.
-
If multiple products from one order are delivered separately, the cooling-off period generally starts on the day after the final product has been received.
-
The consumer may exercise the right of withdrawal by, among other means:
-
the designated online withdrawal or cancellation function on the website;
-
the model withdrawal form;
-
an email to support@carder-essentials.com;
-
or another unambiguous statement showing that the consumer wishes to withdraw from the agreement.
-
-
Use of the model withdrawal form is not mandatory.
-
The consumer does not have to provide a reason for the withdrawal.
-
After the consumer has withdrawn from the agreement, the product must be returned no later than 14 days thereafter.
-
During the statutory cooling-off period, the consumer may inspect, assess and try on the product to the extent necessary to establish its nature, characteristics, size and functioning, comparable to what would reasonably be possible in a physical store.
Control tag and protective films during the statutory cooling-off period
-
Watches and certain other products may be supplied with a Carder Essentials control tag and protective films.
-
Carder Essentials asks the consumer to leave the control tag and all protective films intact and attached as much as possible while inspecting and trying on the product.
-
Merely removing a control tag or protective film during the statutory cooling-off period does not automatically result in the loss of the statutory right of withdrawal.
-
If a control tag or protective film is removed and, as a result, the consumer has handled the product beyond what was necessary to establish its nature, characteristics and functioning, Carder Essentials may charge for demonstrable depreciation in value, to the extent permitted by law.
-
When assessing any depreciation in value, the following may be taken into account, among other things:
-
the condition of the product;
-
scratches or damage;
-
signs of use;
-
missing protective materials;
-
missing or damaged tags;
-
and the extent to which the product has demonstrably decreased in value as a result.
-
The consumer’s statutory rights remain fully applicable at all times.
Additional 60-day return service
-
In addition to the statutory right of withdrawal, Carder Essentials offers an additional voluntary return period of a total of 60 days after receipt of the order.
-
During the first 14 days, the consumer’s statutory rights remain fully applicable.
-
From the end of the statutory withdrawal period up to and including day 60, the additional voluntary return service of Carder Essentials applies to returns due to, for example, a change of mind or change of choice.
-
For returns registered after the statutory cooling-off period has expired, the additional conditions in this article and Article 12 apply.
-
To make use of the voluntary return service from day 15 up to and including day 60, the product must:
-
be unworn and unused;
-
be free from scratches, damage and signs of use;
-
be complete with all accessories and parts;
-
where reasonably possible, be returned in the original packaging;
-
still have all original protective films fully intact;
-
and still have the original Carder Essentials control tag fully intact and attached to the product.
-
If, during the voluntary return period:
-
the control tag has been removed;
-
the control tag has been cut;
-
the control tag has been damaged or reattached;
-
one or more protective films have been removed;
-
or the product shows clear signs of use,
then the voluntary return service from day 15 up to and including day 60 can no longer be used.
-
For the voluntary return service, removal of the control tag and/or protective films is considered acceptance of the condition of the product and an indication that the product has been put into use.
-
This provision applies solely to the additional voluntary return service and never limits:
-
the statutory right of withdrawal during the statutory cooling-off period;
-
the statutory warranty;
-
or other mandatory consumer rights.
Article 7 – Costs and reimbursement upon withdrawal
-
The direct costs of a normal return shipment are borne by the consumer, provided that the consumer was correctly informed of this before the agreement was concluded.
-
If Carder Essentials has delivered the wrong product or if the product does not conform to the agreement, the necessary return costs will be borne by Carder Essentials to the extent required by law.
-
In the event of a valid withdrawal within the statutory cooling-off period, Carder Essentials will refund all payments received from the consumer for the returned product in accordance with the statutory time limits.
-
If the entire order is withdrawn, the original cost of the least expensive standard delivery option offered by Carder Essentials will also be refunded.
-
Additional costs resulting from the consumer choosing a more expensive shipping method than the least expensive standard delivery option do not have to be refunded.
-
In the event of a partial return, the original shipping costs will not be refunded to the extent permitted by law.
-
Carder Essentials may withhold reimbursement until:
-
the returned product has been received; or
-
the consumer has demonstrated that the product has been returned,
-
whichever occurs first.
-
Reimbursement will in principle be made using the same payment method as used for the original payment, unless otherwise agreed.
-
When using the voluntary return service between day 15 and day 60, the original shipping costs will not be refunded unless Carder Essentials indicates otherwise.
-
The consumer is advised to retain proof of return shipment until the return has been fully processed.
-
If, during the statutory cooling-off period, the product has decreased in value because the consumer handled it beyond what was necessary to assess it, this depreciation may, to the extent permitted by law, be deducted from the amount to be refunded.
Article 8 – Exclusion of the right of withdrawal
-
The statutory right of withdrawal may only be excluded where permitted by law and where this has been clearly communicated to the consumer before the agreement is concluded.
-
This may apply, among other things, to products:
-
made to the consumer’s specifications;
-
that are clearly personalised;
-
or that are unsuitable for return for reasons of health protection or hygiene after a seal applied for that purpose has been broken following delivery.
-
-
Personalised products may include, for example, jewellery or watches that have been specially provided with a name, text, date, initials or personal engraving for the consumer.
-
The Carder Essentials control tag and normal protective films on a watch are not automatically regarded as a statutory hygiene seal.
-
Removing a normal control tag or normal protective film during the statutory cooling-off period therefore does not automatically exclude the statutory right of withdrawal.
-
For the voluntary return service from day 15 up to and including day 60, Carder Essentials requires that the control tag and protective films remain fully intact.
-
Earrings and other jewellery are not automatically excluded from the right of withdrawal solely because of their nature.
-
Any hygiene exception is applied only where the statutory conditions for doing so have been met.
-
If the statutory right of withdrawal is excluded for a specific product, this will be clearly stated before the order is placed.
Article 9 – The price
-
All prices shown by Carder Essentials to consumers include VAT, unless expressly stated otherwise.
-
Any shipping costs and other mandatory additional charges will be clearly displayed before the order is completed.
-
The price shown during checkout is the price applicable to the agreement, except in the case of obvious errors or mistakes.
-
Carder Essentials may change its prices and offers for future orders.
-
Price changes do not affect orders that have already been confirmed, unless there is an obvious error that the consumer could reasonably have recognised.
-
Temporary discounts and promotions apply only during the stated period and subject to any conditions stated in connection with them.
Article 10 – Conformity and warranty
-
Carder Essentials warrants that the products supplied conform to the agreement and to what the consumer could reasonably expect in view of, among other things, the product description, price and nature of the product.
-
The consumer is always entitled to the statutory warranty.
-
In the Netherlands, there is no general fixed warranty period for the statutory warranty. A product must conform to the agreement for the period that may reasonably be expected of it.
-
Any additional commercial warranty provided by Carder Essentials, a manufacturer or another party does not affect the consumer’s statutory rights.
-
If a product does not conform to the agreement, the consumer is entitled, in accordance with the statutory conditions, to remedies such as:
-
repair free of charge;
-
replacement;
-
a price reduction;
-
or termination of the agreement.
-
-
Carder Essentials may refuse a particular remedy if it is impossible or, compared with another statutory remedy, would result in disproportionate costs, to the extent permitted by law.
-
The necessary costs of handling a statutory warranty claim are borne by Carder Essentials to the extent required by law.
-
The consumer is requested to notify Carder Essentials of a defect within a reasonable period after discovering it. A notification made within two months after discovery is in any event considered timely.
-
Carder Essentials may ask the consumer to provide photographs, videos or other reasonable information if this is necessary to assess the issue.
-
Statutory warranty rights cannot be refused solely because:
-
the original product packaging is no longer available;
-
a control tag has been removed;
-
or protective film has been removed.
-
Removal of the control tag or protective film therefore does not automatically limit the consumer’s right to invoke the statutory warranty if the product is defective or does not conform to the agreement.
-
Damage demonstrably caused by, for example:
-
incorrect or improper use;
-
an accident;
-
normal wear and tear;
-
deliberate damage;
-
or use contrary to clearly provided care instructions,
is not automatically covered by the statutory warranty.
-
In assessing this, account is taken of what the consumer could reasonably expect in view of the product, material, price and claims made about the product.
-
Care advice regarding, for example, contact with water, perfume, cosmetics, chemicals or perspiration does not limit the consumer’s statutory rights if a product does not meet what could reasonably be expected.
Article 11 – Delivery and performance
-
Carder Essentials exercises the greatest possible care when processing and fulfilling orders.
-
The delivery address provided by the consumer when placing the order is considered the place of delivery.
-
The consumer is responsible for checking and correctly entering the delivery address.
-
Delivery times stated on the website are indicative unless a specific delivery date has expressly been agreed.
-
If no other delivery period has been agreed, the order will be delivered no later than within the period required by applicable law.
-
If an order is delayed or cannot be fulfilled, the consumer will be informed.
-
In the event of delayed delivery, the consumer retains all statutory rights.
-
If delivery of an ordered product proves impossible, Carder Essentials will inform the consumer and may offer a suitable alternative.
-
An alternative product will only be supplied if the consumer agrees to it.
-
If the agreement is terminated because a product cannot be delivered, the amount paid will be refunded in accordance with the statutory time limits.
-
The risk of damage to or loss of the product remains with Carder Essentials until the product has been received by the consumer or by a third party designated by the consumer who is not the carrier.
-
If a package is lost in transit before it has been received by the consumer, Carder Essentials remains responsible for providing an appropriate solution in accordance with the law.
Article 12 – Additional return conditions
-
Additional return conditions apply to the voluntary return service between day 15 and day 60.
-
Returns must be registered through the return procedure offered by Carder Essentials.
-
After a return has been registered, the consumer will receive instructions for returning the product, where applicable.
-
The consumer is advised to use a trackable shipping method and retain proof of shipment until the return has been fully processed.
Watches and products with a control tag
-
Where applicable, watches are supplied with:
-
one or more protective films;
-
and/or a Carder Essentials control tag.
-
-
For a return under the voluntary 60-day return service, from day 15 onwards:
-
all original protective films must still be fully present and intact;
-
the Carder Essentials control tag must be fully intact;
-
the control tag must still be attached to the watch in the original manner;
-
and the product must be unworn, unused and undamaged.
-
-
A control tag must not:
-
have been removed;
-
have been cut;
-
have been opened;
-
have been damaged;
-
have been replaced;
-
or have been reattached to the product.
-
-
For the voluntary return service, protective films must not have been removed and subsequently reapplied.
-
If the control tag or one or more protective films have been removed, the product will be considered accepted for the purposes of the additional return service from day 15 onwards and can no longer be returned due to a change of mind or change of choice under the voluntary 60-day return policy.
-
The same applies if the watch:
-
has visibly been worn;
-
contains scratches or other signs of use;
-
is damaged;
-
is missing parts or accessories;
-
or is otherwise no longer in its original, resalable condition.
-
The foregoing does not affect:
-
the statutory right of withdrawal during the statutory cooling-off period;
-
statutory warranty rights;
-
or rights where Carder Essentials has supplied an incorrect or defective product.
-
If a control tag or protective film is removed during the statutory cooling-off period, Carder Essentials will assess the return in accordance with the statutory rules on withdrawal and any depreciation in value.
-
During the first 14 days, a return will therefore not be refused solely because a control tag or protective film has been removed.
-
Similar conditions may apply to products other than watches if the product is supplied with a clearly identifiable control tag or protective film. If this is the case, this will be clearly communicated to the consumer.
Other return conditions
-
Products that, after the statutory cooling-off period has expired, have visibly been worn, used, damaged or are otherwise in a condition that means they cannot reasonably be resold are excluded from the voluntary 60-day return service.
-
Products must be returned complete with the accessories and parts originally supplied.
-
The absence of or damage to only the outer shipping packaging does not automatically result in refusal of a return.
-
If Carder Essentials additionally offers an exchange service, products may be exchanged in accordance with the return and exchange instructions stated on the website.
-
If a direct exchange is not possible, the consumer may return the product and place a new order.
Article 13 – Payment
-
The available payment methods are displayed during checkout.
-
The consumer is responsible for providing correct payment, billing and contact information.
-
If a payment cannot be processed successfully, Carder Essentials is not obliged to fulfil the order until payment has been made.
-
When using an external payment service, the terms and conditions of that payment service may also apply.
-
The consumer is required to notify Carder Essentials as soon as possible of any inaccuracies in the payment information provided.
-
In the event of late payment, costs may only be charged to the extent permitted by law.
Article 14 – Complaints procedure
-
Carder Essentials has a complaints procedure and handles complaints carefully and within a reasonable period.
-
Complaints may be submitted via:
Email: support@carder-essentials.com
-
When submitting a complaint, the consumer is requested, where possible, to provide the following information:
-
name;
-
order number;
-
a clear description of the complaint;
-
and, where relevant, photographs or videos showing the issue.
-
-
The consumer must report a defect within a reasonable period after discovering it. A notification made within two months after discovery is in any event considered timely.
-
Carder Essentials aims to provide a substantive response to complaints as soon as possible.
-
If more time is needed to handle a complaint, the consumer will be informed.
-
Carder Essentials aims to reach an appropriate solution together with the consumer.
-
If a complaint concerns a product that does not conform to the agreement, all statutory warranty rights of the consumer remain fully applicable.
-
The absence of a control tag or protective film is not in itself a reason to reject a complaint about a defective product without further assessment.
Article 15 – Disputes and applicable law
-
Agreements between Carder Essentials and consumers are governed by Dutch law.
-
If a consumer resides outside the Netherlands, this choice of law may not result in the consumer losing the protection of mandatory consumer law provisions that apply under the law of their habitual residence.
-
Carder Essentials and the consumer will initially attempt to resolve any dispute by mutual consultation.
-
If the parties are unable to reach a solution, the dispute may be submitted to the competent court.
-
The statutory rules regarding the competent court in consumer agreements remain fully applicable.
-
The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply to consumer agreements covered by these Terms and Conditions.
Article 16 – Additional or deviating provisions
-
Additional provisions or provisions that deviate from these Terms and Conditions may not conflict with mandatory consumer law.
-
Additional arrangements will be recorded in writing or electronically where necessary to make them known and accessible to the parties.
-
Carder Essentials may amend these Terms and Conditions from time to time, for example due to changes in legislation, business operations or services offered.
-
In principle, an order is governed by the Terms and Conditions that applied at the time the agreement was concluded.
-
The most recent version of these Terms and Conditions will be published on the Carder Essentials website.
-
If one or more provisions prove to be invalid or unenforceable, the remaining provisions will remain fully in force.
